GENERAL INFORMATION

1.1 The owner of the website/shop, as well as the seller under the provisions of the Civil Code, is the company KOMITYWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, based in Warsaw, registered in the Central Register and Information on Business Activity in Warsaw with NIP number 5242832497, REGON 367359745, and KRS 0000680112, District Court for the Capital City of Warsaw, XIV Commercial Division of the National Court Register, hereinafter referred to as the Seller.

SCOPE OF APPLICATION OF THE REGULATIONS AND AMENDMENTS

2.1 The regulations define the terms of product sales by KOMITYWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, order placement, and conclusion of sales agreements.

2.2 Matters not regulated by the Regulations are governed by the provisions of the Civil Code and specific laws.

2.3 The current version of the Regulations is available to the Customer in the "Regulations" section on the shop's website.

2.4 The shop owner reserves the right to make changes to the Regulations at any time by publishing a new version on the website.

2.5 The Ordering Party may save the Regulations by copying or printing the content at any time.

PRODUCT INFORMATION

3.1 Products offered in the shop are identified by product name and price. Information includes the material used, special properties, dimensions, or colors, expected delivery time, and other details deemed valuable for the Customer by the Seller.

3.2 Product photos and presentations are for display purposes only. Any deviations from the actual appearance cannot constitute grounds for claims. (Products are handmade, making it impossible to replicate their appearance precisely. Differences may include natural features of plywood, such as shade, grain, knot visibility, etc.)

3.3 All prices on the ototo.furniture website are gross prices in Polish zloty and include 23% VAT.

3.4 Product prices include shipping costs within Poland.

3.5 The available product range, specifications, and prices are subject to change. For example, products may be added or removed from circulation, or promotions may be introduced or withdrawn. However, changes made after concluding a sales agreement do not affect Customers who have already concluded such agreements.

3.6 The product information on the website does not constitute an offer as defined in Articles 66 and 661 of the Civil Code but is an invitation to submit an offer to conclude a sales agreement under Article 71 of the Civil Code.

TERMS OF PURCHASE, DATA PROTECTION, AND INFORMATION ABOUT THE AGREEMENT

4.1 To make a purchase, the Customer must read and accept these Regulations, confirming this by selecting the appropriate field on the form available on the shop’s website during each transaction.

4.2 The conclusion of the sales agreement is preceded by submitting an order on the website form and a declaration that the provided data is accurate.

4.3 The Customer must provide precise and current information on the form. The Seller reserves the right to withdraw from fulfilling the order if the information provided is incomplete or incorrect and obtaining correct information is impossible due to the Ordering Party’s fault.

4.4 An order is accepted for processing once the Customer receives an email confirming the order, marking the moment of concluding the purchase agreement between the Customer and the Seller.

4.5 The personal data administrator is KOMITYWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, based in Warsaw, registered in the Central Register and Information on Business Activity with NIP 5242832497 and REGON 367359745. The Administrator is obligated to protect personal data from unauthorized access. Data may be used only for order processing purposes and for marketing purposes only with the Customer’s consent.

4.6 Agreements concluded following order acceptance are distance contracts and are governed by the Act of March 2, 2000, on consumer protection and liability for damage caused by dangerous products, as well as other relevant laws.

MAKING PURCHASES AND DELIVERY TERMS

5.1 Processing of the order is conditional on full payment by the Customer in advance, based on the order confirmation received.

5.2 The Ordering Party may pay via:

5.3 Each product has an individual processing time, specified in weeks, from payment receipt to dispatch. The longest processing time applies if products with varying times are ordered.

5.4 The maximum processing time is four weeks. Delivery time depends on the selected delivery method:

  • Delivery by KOMITYWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ – individual arrangements apply
  • Personal collection – by appointment
  • Delivery outside Poland depends on the destination country.

5.5 Orders to Switzerland, Norway, and the UK are subject to additional customs and VAT fees, charged directly by local tax authorities and payable separately by the Customer.

5.6 Large shipments, such as tables and cabinets, are pallet-shipped without home delivery.

5.7 The courier company is solely responsible for delays in delivery.

5.8 The Ordering Party will be informed of the shipment and provided with a tracking number via email upon dispatch.

5.9 Orders can be placed without registration. Orders are placed using a form developed by the shop by adding products with selected quantity and color to the shopping cart.

5.10 After filling in the shipping details, the Customer may confirm the order by clicking “Buy and Pay,” which completes the order. After confirming, no changes can be made to the order.

5.11 An order placed per point 5.10 constitutes the Seller’s offer to the Customer for purchasing the listed products at the indicated price, including delivery costs.

5.12 Upon placing an order, the Customer will receive an email confirmation.

5.13 The Seller reserves the right to reject the order with a reason provided if the regulations are not followed or as justified.

5.14 Order confirmation must include the product list, price, payment terms, and delivery method and address. Receipt of payment confirmation marks the sales agreement conclusion.

COMPLAINTS AND RETURNS

6.1 The Ordering Party must check the shipment and its contents in the presence of the Courier.

6.2 In case of transport damage, the Ordering Party should act per the Law on Transport of November 15, 1984, to ensure the Courier’s responsibility by documenting the shipment's condition and damage circumstances.

6.3 All products in the KOMI.FURNITURE store are new and covered by a 24-month manufacturer’s warranty. The warranty excludes wear and tear damage due to regular use, such as scratches or misuse.

6.4 The Seller is committed to honoring the warranty if the product was used as per the manufacturer’s instructions and has a technical defect.

6.5 The Seller is liable to consumers for non-compliance of products with the sales agreement, per the Act of July 27, 2002, on specific consumer sales conditions and amendments to the Civil Code, and other separate provisions.

6.6. Complaints should be submitted in writing or electronically to the address provided in the order confirmation sent electronically. For the complaint to be considered valid, it must include the Customer’s information, correspondence address, reason for complaint, identification of the defect, date of its discovery, proof of purchase, and the product in question after prior notification to the Seller. Shipping costs are borne by the Customer.

6.7. The Seller will review the complaint and inform the Customer of the decision within 14 days from the date of receiving the complaint, provided it meets the conditions outlined in point 6.6 above.

6.8. The Seller may refuse to accept a complaint if the product is returned without prior notification or without meeting the conditions described in point 6.6. If the complaint is incomplete, the Seller will request the Customer to complete it, and the 14-day period will start from the day the complaint is completed.

6.9. If the complaint is accepted, the Seller will send the Customer a defect-free product (new or repaired to ensure no defects) at their own expense or refund the price of the product in question.

6.10. The Customer may withdraw from the sales contract within 14 days of receiving the goods, without providing any reason, and return the goods promptly to the store.

To exercise the right to withdraw from the sales contract, a statement of withdrawal must be submitted electronically or in writing.

Upon submission, the products subject to the contract (in unused condition) must be returned along with documents confirming compliance with the 14-day period from the date of purchase (receipt or invoice).

6.11. In the event of withdrawal from the contract as outlined in point 6.10, the Seller is obligated to promptly refund the funds to the bank account provided by the Customer, no later than within 14 days.

6.12. The Seller may refuse to accept packages sent cash on delivery or at the store's expense.

6.13. Personalized products made according to the Customer’s specific instructions, not part of the regular KOMI.FURNITURE store offer, are non-returnable.

FINAL PROVISIONS

7.1 All information, product photos, and trademarks are copyright-protected.

7.2 All disputes will be resolved amicably, and if not, the competent court will be determined per the Consumer Code.

7.3 Matters not regulated herein are governed by consumer protection and liability law.

7.4 Disputes arising from the Regulations and contracts between the Seller and Customers will be settled by the competent court per the Civil Procedure Code.

7.5. Placing an order constitutes acceptance of the provisions of these Regulations.
